Implementation of the UTP Directive

Requirements for trade and supplier contracts in the new AgrarOlkG

With the Unfair Trade Practices (UTP) Directive, the European legislator has prohibited various types of agreements in supply contracts and general terms and conditions. The German legislator has implemented this directive and issued additional prohibitions. Similar measures can be observed in other EU member states. In order to protect themselves from high fines, the invalidity of contractual clauses and the publication of the company name in the event of infringements, every buyer and seller must be well aware of the new prohibitions.
